Spying in the Name of Love

Have you ever wondered if your significant other or spouse is cheating and been tempted to play sleuth? People have been catching their spouses or boyfriends/girlfriends cheating for centuries, but it took some real effort. Nowadays, it has become so easy due to technology.

Thirty-three percent of dating couples and 37 percent of spouses — slightly more women than men — say they have checked their partner’s email or call history on the sly, according to a survey last year by the gadget shopping site Retrevo.com, which queried more than 1,000 people online. Among those under 25, almost half reported snooping. Just 9 percent discovered evidence of cheating.

Retrevo.com spokeswoman Jennifer Jacobson said she doesn’t think young couples are less trusting. “It’s just that technology has made everyone’s communications highly accessible and people probably don’t see it as a violation of trust, because of how easy it is to do.”

When Patricia Masterson’s boyfriend broke into her email account in search of evidence that she had been cheating, she was deeply offended by the violation of her privacy. The fact that she had, indeed, been cheating hardly seemed like a good excuse.

She changed her tune 10 years later, when, married and pregnant, Masterson innocently spotted a text message on her husband’s cellphone from a woman regarding a baby. Her husband said it must have been sent to him by mistake, and Masterson, sensitive to privacy, left it alone — until a few months later, when the woman contacted Masterson through Facebook to reveal she’d recently given birth to her husband’s child.

Masterson said, “I became a snooper.” She poured through cellphone records and installed software to recover deleted emails, gathering all the details she could. “It was so not me; up until that point I had believed in absolute privacy.”

When, if ever, is it OK to invade a romantic partner’s privacy? Many say it’s often the only way to confirm suspicions of infidelity when all else fails. I am not sure what “all else” includes – asking and hoping for an honest answer? Hiding behind closed doors and eavesdropping on phone conversations? Following your partner? Cellphone Spying Becoming Easier for Abusers and Stalkers

Here is one company’s promise on its website to anyone who wants to eavesdrop on someone else’s cellphone: “You could now listen in 100% completely undetected.”

The average person now has easy access to spy technology allowing them to gather cellphone information, read private emails, and track someone’s location using GPS. Experts say that the technologies are being used by spouses and partners to track, harass and stalk. “Technology has just exploded. It’s so sophisticated now and it’s very easy to utilize these different technologies to keep tabs on a person and find out where they’re going,” said Gina Pfund, chief assistant prosecutor of the Domestic Violence Unit in Passaic County.

This is very scary stuff when this type of technology gets into the wrong hands or is abused. I know of one woman who was being stalked by her ex-boyfriend and eventually learned he was tracking her whereabouts via her cellphone.

Experts say the person watching or listening is often a family member and frequently a suspicious or controlling partner. They have scanned Facebook pages, viewed online web-browsing histories, and exam­ined cellphone records for proof. However, some take it a step further, planting spyware on smart phones and computers.

Spyware is being aggressively marketed online as a means to find out if a spouse is cheating. It can be in­stalled on computers to monitor keystrokes, emails and passwords and to take screen snapshots. Spy software can also be installed on a smart phone to allow a third party to monitor calls, view text messages and photos, and track a person’s location and movement via GPS. A built-in microphone can also be remotely activated and used as a listening device, even when a phone is turned off. Technology experts say the phone user has no idea they are being spied on. N.J. Court Approves GPS Tracking on Spouse Suspected of Cheating

Family law options such as collaborative law and divorce mediation are often good options if the spouses can reach amicable agreements with respect to issues of child custody, property division and visitation. However, sometimes contentious disputes over hidden assets, infidelity or other deception cause hard feelings that may require a judicial determination of key divorce issues.

Admissions or evidence of adultery are the most obvious source of ill will in divorce, whether a spouse’s lack of faithfulness is the primary motivating factor in the divorce or the infidelity is discovered during the divorce process. While a spouse can uncover evidence of adultery in many ways, sometimes a wife or husband finds it necessary to seek professional help to confirm his or her suspicions.

A recent New Jersey appellate court opinion considered the role of technology in investigating a spouse suspected of infidelity. The case involved a Gloucester County law enforcement officer whose wife suspected that he was having extramarital relations. She hired a private investigator  in 2007 to confirm whether he was indeed having an affair. After failed attempts to successfully tail the husband, the PI recommended that she place a global positioning system (GPS) in the glove compartment of his vehicle to track his whereabouts.

The resulting evidence confirmed her suspicions of infidelity and led to a lengthy divorce that was finalized in 2009. However, the husband had further legal issues he wished to settle and he filed a claim against the private investigator for intentional and negligent invasion of privacy, alleging that he had suffered emotional harm as a result. First Thoughts: Here We Go Again

*** “Here we go again”: Herman Cain’s reaction — in advance (talk about a shrinking news cycle!) — to a woman’s allegation that she had a 13-year-old affair with the GOP presidential candidate sums up the state of Cain’s campaign, as well as the state of the Republican horserace: “Here we go again.”

As Cain told CNN before a local Atlanta TV station aired its report of the allegation, “My wife’s reaction was very similar to mine: Here we go again… We will basically show when the details become available that I didn’t do anything wrong.” The multiple sexual-harassment allegations against Cain may not have ruined his candidacy, though they certainly knocked him off message.

His pregnant pause when talking about Libya might not have killed his chances, but it did bring into question his lack of experience and knowledge about world affairs. And this new allegation of an affair might not be the final nail in his political coffin, but we aren’t seeing the same conservatives rallying around Cain that we saw after the sexual-harassment allegations first surfaced. But when you take them all together, it’s pretty clear we’re watching a replay of the “Sixth Sense”: Everyone knows this candidacy is dead, except the campaign. Cain and the allegations have become a sideshow, bordering on a distraction to the rest of the field.

It may be time for Cain to pack-up and go home.
