Cheating husband tries to sue wife and PI for placing GPS in car

After a cheating husband, Kenneth Villanova, sued his wife and her private investigator, Richard Leonard, for an invasion of privacy, the New Jersey court ruled against him.

Mr. Villanova argued that his wife was invading his privacy by placing a GPS tracker in his car. The court found that this was not true, since the GPS tracked Mr. Villanova on public streets. The GPS was doing the same job of a person physically following his car, therefore, he cannot expect privacy on public streets.

This case led NJ to make tracking spouses with GPS trackers legal.

SEC Drops Moody’s Fraud Investigation

MoneyMoneyMoneyThe Securities and Exchange Commission (SEC) announced that they decided to drop a fraud investigation into Moody’s, the credit rating agency. This, according to an article in the Washington Post.

Moody’s computer crediting ratings wrongly attributed AAA ratings to nearly $1 billion in debt, inadvertently causing the debt to show that they yielded high returns while offering low risk of loss. The computer malfunction occurred in 2007 and Moody’s repaired the error. They did not, however, change the debt’s triple-A rating due to possible repercussions that would obviously damage the company’s highly esteemed reputation.

According to the SEC, the investigation was dropped due to “jurisdictional limitations,” meaning that the debt notes were released in Europe, which was beyond the SEC’s scope of operations.  Now, a recently passed law allows the SEC to file suit against credit rating firms when they’re involved in fraudulent business practices outside territorial boundaries.

Three ratings services–Moody’s, Standard & Poor’s and Fitch Ratings–issue letter grades to complex securities that help investors determine whether to take on the risk. The higher the rating, the lower the risk. However, Congressional investigation show that the ratings services gave high grades to risky notes, including subprime mortgage securities.

The rating agencies claim that they’ve restructured their operations, and that they issue opinions on debt security, and investors need to rely on other sources besides their ratings.

Marriage Woes? When to Call a Private Investigator

With the divorce rate hovering at about 50%, couples seem to have more trouble than in past years trusting one another. Marriages are tenuous these days despite the fact that we promise “until death.”
This distrust has led to confusion, and we often jump to conclusions before getting the facts.

So, if you have the slightest doubt in your spouse due to a change in their habits, before jumping the gun and throwing out accusations, find out the facts first. Confrontation with him/her will cause one of two things: more careful behavior from your spouse, or heated arguments.

The best thing to do in this situation is to find out the facts. Hire a private investigator.

Some of the signs that your spouse may be having an illicit relationship include, but are not limited to;

1. Increased time by your spouse enhancing, or worrying about, their appearance.
2. Attitude changes; too loving, or sarcastic an uncaring.
3. Phone calls that, when answered, don’t have anyone on the line.
4. Increased cell phone use, or walking out of the room to have conversations.
5. Increased use of cash instead of a credit/debit card.
6. Your spouse spends more time than usual shopping for groceries or running errands.
7. Increased computer use.

A private investigative service will be able to provide surveillance services, lie detection services, or even listening/viewing equipment installation in offices, cars, and other locations.  In any event, the detectives will help you find out the truth, because the above items are indicative of things more than having affairs. While not a “better” alternative, it could indicate substance abuse or a gambling problem. Or, it could mean that things are heating up at work. In any event, don’t jump to conclusions before gathering the facts.

The bottom line is that the time and effort put into your relationship is valuable. Throwing it all away due to misconceptions or false accusations isn’t going to help either one of you. If you do find out your spouse is having an affair, at least you will have the facts in order to deal with it in a proper, logical manner. Your spouse won’t be able to “talk you out of” your suspicions because you’ll have the evidence.
